These Terms & Conditions ("Terms") govern your access to and use of the website GBA Remodeling and the services provided by GBA Remodeling ("we", "us", "our"). By using our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our site or request services.

1. Services

We provide home construction, renovation, remodeling, and related consulting services. Service details, scope, specifications, pricing, and timelines are set out in quotes, proposals, work orders, and contracts provided to you (each a "Contract").

2. Quotes, Estimates & Contract Formation

• All quotes and estimates provided are based on the information available at the time and are valid for the period specified in the quote. We reserve the right to update estimates if project scope, site conditions, or material costs change.
• A Contract is formed only when we provide a written proposal or agreement that you sign (or otherwise accept in writing) and any required deposit is received.
• Verbal estimates or informal communications are not binding unless confirmed in a written Contract.

3. Payment Terms

• Payment schedules, deposits, milestones, and final payment terms will be set out in the Contract.
• Unless otherwise agreed, deposits are non-refundable once work has been scheduled or commenced.
• Late payments may incur interest and/or suspension of work until payments are brought current.
• We use third-party payment processors for online payments. You agree to their terms when using those payment services.

4. Changes, Variations & Site Conditions

Construction projects often require adjustments. You agree that:

• Any change requests (variations) must be made in writing and may affect price and timeline.
• Unexpected site conditions (hidden damage, hazardous materials, or structural issues) discovered after work begins may require additional work and charges.
• We will advise you of necessary changes and obtain your approval before proceeding where feasible.

5. Access & Permits

• You must provide reasonable access to the site, utility connections (water, electricity), and safe working conditions.
• You are responsible for obtaining any necessary permits, unless your Contract states we will obtain them; in that case, permit fees and timelines will be included or billed separately.

6. Materials, Suppliers & Subcontractors

We may use subcontractors and suppliers. Materials are supplied based on availability; if specified products are unavailable we will propose reasonable alternatives. Title to supplied materials remains with us until paid in full, unless otherwise agreed.

7. Warranties & Guarantees

• Where applicable, we provide workmanship warranties as specified in your Contract. Manufacturer warranties for fixtures or materials are governed by those manufacturers' terms.
• Warranties do not cover damage from misuse, normal wear and tear, acts of God, or alterations by third parties not approved by us.

8. Intellectual Property

All content on the website (text, images, logos, designs) is owned by or licensed to GBA Remodeling. You may not reproduce or use our intellectual property without prior written permission. We grant you a limited, revocable license to view and download site content for personal, non-commercial use only.

9. User Content

If you submit content (project photos, testimonials, reviews), you grant us a non-exclusive, royalty-free right to use, display, and reproduce that content for marketing and portfolio purposes. Do not submit confidential or personal data you do not want published.

10. Limitation of Liability

To the fullest extent permitted by law, in no event will GBA Remodeling or its affiliates be liable for any indirect, special, incidental, consequential, or punitive damages arising from your use of the website or our services, even if we have been advised of the possibility of such damages. Our aggregate liability for any claim arising out of or related to a Contract will not exceed the total fees paid to us under that Contract.

11. Indemnity

You agree to indemnify and hold harmless GBA Remodeling, its employees, agents, and subcontractors from any claims, losses, liabilities, damages, costs, or expenses (including legal fees) arising from your breach of these Terms, your negligent acts, or your violation of third-party rights.

12. Insurance

We maintain appropriate insurance for our operations (where applicable). You are responsible for insuring your property and personal possessions during construction unless otherwise agreed.

13. Termination & Cancellation

• Either party may terminate a Contract in accordance with the termination provisions set out in the Contract.
• Cancellation may incur fees for work performed, materials ordered, and other non-recoverable costs.

14. Dispute Resolution

If a dispute arises, we prefer to resolve it amicably. Please contact us to discuss. If unresolved, disputes may be referred to mediation or arbitration where agreed. You may also pursue remedies available under applicable law.

15. Governing Law

These Terms are governed by the laws of the jurisdiction where GBA Remodeling is registered (replace with your local governing jurisdiction in the Contract). Any legal action must be brought in the courts of that jurisdiction, subject to applicable mandatory rules.

16. Third-Party Links & Services

Our website may link to third-party sites and use third-party services (hosting, analytics, payment processors). We are not responsible for their content or practices; please review their terms and privacy policies separately.

17. Changes to These Terms

We may update these Terms from time to time. We will post updated Terms on this page with a revised "Effective date." Continued use of the website or services after updates indicates acceptance of the revised Terms.

18. Severability

If a court finds any provision of these Terms invalid or unenforceable, the remaining provisions will remain in full force and effect.

19. Entire Agreement

These Terms, together with any written Contract between you and GBA Remodeling, constitute the entire agreement and supersede prior agreements, negotiations, and understandings.
